01 How to respond to an EPFO Section 7A assessment summon?
A summons issued under Section 7A of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 represents a formal quasi-judicial inquiry initiated by an Assistant or Regional Provident Fund Commissioner (RPFC). The purpose of the inquiry is either to determine statutory coverage of an establishment or to assess whether dues have been omitted, suppressed, or calculated incorrectly on employee wages.
Upon receipt of a Section 7A summon, an establishment must avoid failing to appear, as non-appearance triggers an ex-parte assessment order and immediate bank account attachment under Section 8B. Employers must promptly appoint an authorized representative through a formal authorization letter and prepare an itemized documentation dossier consisting of:
- Audited balance sheets, profit and loss statements, and trial balances corresponding to the inquiry period.
- Monthly wage breakup registers and attendance muster rolls verifying basic wages versus exempt allowances.
- Electronic Challan cum Return (ECR 2.0) payment receipts and bank transaction proofs confirming timely remittances.
- Contractor agreements and vendor EPF compliance certificates (Form 5A, monthly challans) for third-party manpower.
Submitting a structured written submission with supporting evidentiary exhibits refutes inflated departmental estimates, restricts liability to verifiable wages, and prevents arbitrary unilateral determinations.
