Statutory Law • EPF Scheme, 2026 (Gazette June 29)

EPF Scheme, 2026 & Code on Social Security 2020: The Binding Withdrawal Framework

Published in the Gazette of India on June 29, 2026, repealing the 1952 Scheme and codifying uniform service standards, mandatory balance retention, and digital tax declaration rules into operative law.

🛡️

The 25% Mandatory Retention Floor

To prevent predatory retirement corpus depletion, the EPF Scheme, 2026 legally mandates that at least 25% of total provident fund balances must remain locked in the account while employed. This ensures continuous annual compound interest at 8.25% p.a., preventing members from draining their accounts prior to superannuation.

⏱️

Uniform 12-Month Service for All Advances

The archaic 5-year (Housing) and 7-year (Marriage) waiting periods have been abolished. Crucially, the old zero-wait exception for medical illness has also been eliminated. All partial advances under the EPF Scheme, 2026 uniformly require 12 completed months of continuous contributory membership.

📝

Transition to Digital Form 121 for TDS

For withdrawals executed prior to 5 years (60 months) of service exceeding ₹50,000, 10% TDS applies under Section 192A. The old paper/PDF Form 15G/15H has been superseded by the statutory digital Form 121, integrated directly into the unified claim portal.

⚡

3-Day Algorithmic Settlement Engine

Operating under the ₹5 Lakh ceiling, advance claims matching Aadhaar, NPCI PFMS, and electronic attendance records bypass regional file queues. Funds are auto-disbursed within 72 hours without human APFC intervention.
