EPF Taxation 2026: TDS Rules, the 5-Year Exemption, and the New Form 121 (Replacing 15G)

Published: Oct 12, 2026 • Reviewed by Senior Compliance Retainer Panel

The Employees' Provident Fund (EPF) is one of the most powerful tax-saving instruments available to salaried professionals in India. However, withdrawing your funds prematurely can trigger steep tax penalties if you aren't careful.

Historically, members relied on Form 15G or Form 15H to prevent the EPFO from deducting Tax Deducted at Source (TDS) on their withdrawals. But under the new Income Tax Act regulations rolled out in 2026, the entire TDS declaration process has been overhauled.

Here is your complete guide to understanding the 5-year tax exemption rule, when TDS applies to your EPF advances, and how to navigate the new Form 121 mandate.

The Golden Rule: 5 Years of Continuous Service

The core principle of EPF taxation is simple: the government wants to discourage early depletion of retirement savings.

If you withdraw your PF after completing 5 years of continuous service, the entire withdrawal amount is completely tax-exempt. No TDS will be deducted, and you do not need to submit any tax declaration forms.

What counts as "continuous"?
Continuous service does not mean you must stay at the same company for 5 years. If you switched jobs but successfully transferred your old PF balance to your new employer using Form 13, your service tenures are combined. (e.g., 3 years at Company A + 2.5 years at Company B = 5.5 years of continuous, tax-free service).

When Does TDS Apply? (The ₹50,000 Threshold)

If your combined continuous service is less than 5 years, your EPF withdrawal becomes taxable. The EPFO is legally mandated to deduct TDS at the time of payment if your withdrawal amount exceeds a specific threshold.

TDS is deducted if both of these conditions are met:

  1. Your continuous service is less than 5 years.
  2. Your withdrawal amount is ₹50,000 or more.

The TDS Penalty Rates:

  • 10% Deduction: If your PAN is actively linked and verified with your UAN, the EPFO will deduct TDS at a flat rate of 10%.
  • 20% Deduction: If your PAN is missing, invalid, or not seeded in your KYC profile, the EPFO is forced to deduct TDS at the maximum marginal rate of 20%.

The 2026 Update: Form 121 Replaces Form 15G and 15H

If your service is under 5 years and your withdrawal exceeds ₹50,000, but your overall annual income is below the taxable limit (meaning you have zero final tax liability for the year), you can block the EPFO from deducting the 10% TDS by submitting a self-declaration.

The Massive 2026 Change: For years, members used Form 15G (for those under 60) and Form 15H (for senior citizens). As of April 1, 2026 (Tax Year 2026-27), the CBDT and EPFO have officially abolished Forms 15G and 15H.

They have been replaced by a single, consolidated document: Form 121.

Whether you are a 25-year-old employee taking an unemployment advance or a 62-year-old retiree, you will now use Form 121 to declare nil tax liability. The form generates a 26-character Unique Identification Number (UIN) to streamline processing with the Income Tax Department.

Does TDS Apply to Form 31 Partial Advances?

A common point of confusion is whether partial withdrawals (Form 31 advances) attract TDS.

  • Most Advances are Tax-Exempt: Specific purpose-driven advances under Form 31—such as withdrawals for Medical Emergencies (Para 68-J) or Housing (Para 68-B)—are generally treated as exempt from tax, regardless of your service tenure.
  • The Unemployment Advance (75% Rule): If you lose your job and utilize Form 31 to withdraw 75% of your total corpus after one month, and your service is less than 5 years, this large liquidity event can trigger TDS scrutiny if it exceeds ₹50,000.
  • The Form 121 Safeguard: Even for standard advances, if you have not merged your past PF accounts and the system calculates your tenure as less than 5 years, the portal may automatically flag your high-value claim for TDS. Uploading Form 121 acts as a critical cash-flow safeguard, ensuring you receive your full requested amount without a 10% cut.

How to Submit Form 121 Online

The submission process is integrated directly into the Unified Member Portal:

  1. When initiating a claim via Online Services > Claim (Form-31, 19, 10C), the system will assess your service history and requested amount.
  2. If you fall under the taxable bracket (<5 years and >₹50,000), a prompt to upload your tax declaration will appear.
  3. Download the new Form 121 (Part A), fill in your estimated annual income details, and sign it.
  4. Scan the document as a clear PDF.
  5. Upload the PDF directly into the portal before authenticating your claim with the Aadhaar OTP.

Warning: Once the EPFO processes the payment and deducts TDS, it cannot be reversed by submitting Form 121 late. You will have to wait until the end of the financial year to claim a refund by filing your Income Tax Return (ITR).
